Prowess is a running gait-analysis app published by ShoeSense Inc. (“we”, “us”, “our”). By creating a Prowess account or using the Prowess app you agree to these Terms.
If you do not agree with these Terms, do not use the app.
Prowess analyzes data from a paired wearable sensor and provides:
Prowess is a fitness-tracking tool. It is not a medical device. It does not diagnose, treat, prevent, or cure any condition. Talk to a qualified clinician before changing your training based on the app's output.
You must be at least 13 years old (16 in the EU/EEA) to use Prowess. By using the app you confirm that you meet the age requirement.
You own your gait data. By using the app you grant us a limited, non-exclusive license to store, process, and display that data so the app can function. We use the data only as described in our Privacy Policy.
You can delete your account at any time from Profile → Delete account. Deletion removes your sessions, gait data, and account from our servers within 30 days.

Prowess depends on the Prowess sensor (a small wearable on the shoe). We are not responsible for damage to the sensor caused by misuse, water exposure beyond the rated IP class, drop impact, or modification. The sensor is covered by its hardware warranty (separate document).
If you accept an invite from a coach, that coach can read your sessions until you revoke access from the Profile screen. We do not vet coaches. You are responsible for choosing who to share with.
Prowess is currently free. If we introduce paid tiers in the future we will update this section before charging anyone, give clear in-app notice, and require explicit consent before any subscription begins.
The app is provided “AS IS” without warranties of any kind. We do not guarantee:
To the maximum extent permitted by law, we disclaim all implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
To the maximum extent permitted by law, our total liability for any claim arising from your use of Prowess is limited to the greater of (a) the amount you paid us in the 12 months before the claim, or (b) USD $50. We are not liable for indirect, incidental, consequential, or punitive damages.
You agree to indemnify and hold us harmless from claims arising out of your misuse of the app, your violation of these Terms, or your violation of any third-party right.
You can stop using the app at any time. We can suspend or terminate your access if you breach these Terms. Sections that by their nature should survive termination (data ownership, disclaimers, liability, governing law) survive.
These Terms are governed by the laws of the State of Colorado, USA, without regard to conflict-of-laws principles. Disputes will be resolved in the state or federal courts in Boulder County, Colorado, and you consent to that exclusive jurisdiction.
If we materially change these Terms we will post the new version at this URL and show an in-app notice the next time you open Prowess. Continued use after the change means you accept the new Terms.
